Article 1: Object
Article 1.1: The Contract
These General Terms and Conditions of Sale apply to all orders placed on the website www.materiel-pompier.com.
These terms and conditions define the sales agreement between EUROMAST and the Client, from order placement to services, including payment and delivery. They govern all the necessary steps for placing an order and ensure its tracking between the contracting parties.
These General Terms and Conditions of Sale are the only terms applicable at the time of order placement and supersede all other terms and conditions, unless otherwise agreed in advance, expressly and in writing. EUROMAST reserves the right to adapt or modify these General Terms and Conditions of Sale at any time. The applicable terms and conditions are those in effect on the date the order is validated by the Customer.
Article 1.2: Definitions
The term “Client” means any natural person of legal age acting as a consumer, within the meaning of the Consumer Code, placing an order on the Site for purposes not related to their professional activity.
The Site may, as an ancillary service, allow individuals or legal entities acting for professional purposes to place orders. In this case, certain provisions of these General Terms and Conditions of Sale, in particular those relating to the right of withdrawal and consumer mediation, apply only to consumers.
The "Site" refers to the website www.materiel-pompier.com.
“EUROMAST” refers to the company EUROMAST, SARL with a capital of 60,000 euros, whose registered office is located at 101 rue Louis Armand – Savoie Hexapôle – 73420 Méry, registered with the RCS of Chambéry under number 437 706 401.
Article 1.3: Capacity
The Client declares that they have the full legal capacity to enter into these General Terms and Conditions of Sale.
Article 1.4: Destination
The products offered on the website www.materiel-pompier.com are intended primarily for consumers for personal or non-professional use.
To ensure product availability for all its customers, particularly during promotional offers, EUROMAST reserves the right to refuse or cancel any order deemed abnormal based on objective criteria, including: (i) an order quantity exceeding 5 identical products per item and per customer over a 30-day period, (ii) repeated orders of the same product across multiple user accounts associated with the same delivery or billing address, or (iii) any objective indication of resale activity. In such cases, EUROMAST will inform the customer by email within 48 hours and, where applicable, will issue a full refund of any payments made.
Article 2: Content of the offer
Article 2.1
www.materiel-pompier.com is a website dedicated to the sale of personal protective equipment and equipment related to fire safety, including: helmets, intervention suits, safety shoes, gloves, lighting and other protective equipment.
The products offered for sale are described and presented as accurately as possible. However, photographs and visuals are not contractually binding.
Article 2.2
Product and item offers, as well as delivery terms, are valid in metropolitan France and internationally, subject to the delivery zones offered during the ordering process.
Article 2.3
EUROMAST may offer products with a slightly different composition than described, provided their quality is equivalent or superior. In this case, if the replacement products are not suitable for the Customer, the return shipping costs will be covered by EUROMAST.
Article 3: Availability
Offers are valid as long as they are visible on the Site and while stocks last.
In the event of unavailability after the order has been placed, the Customer will be informed as soon as possible and may choose either to wait for the product to become available, or to be refunded in full within a maximum period of 14 days.
Article 4 Price
Product prices are shown in euros inclusive of all taxes (TTC) , excluding delivery charges.
Delivery charges are specified before order confirmation. Delivery is free for eligible orders over €480 (including VAT) .
EUROMAST reserves the right to change its prices at any time, it being understood that the applicable prices are those in effect at the time of order validation.
Article 5: Order
Any order constitutes acceptance of the prices and descriptions of the products available for sale on the Site as well as the Customer's full and complete acceptance of these General Terms and Conditions of Sale.
In accordance with the provisions of the Civil Code relating to the conclusion of contracts by electronic means, the Customer has the opportunity to check the details of his order and correct any errors before final validation.
Order confirmation, after acceptance of the terms and conditions, constitutes consent and formation of the contract.
Article 5.1: Creation of a user account
Before placing an order, the Customer must create a user account by providing accurate and complete information necessary for processing the order.
Article 5.2: Ordering and tracking
The order process follows the steps described on the Website. A confirmation email is sent to the Customer after validation and receipt of payment.
Article 5.3: Archiving
Orders are archived on reliable and durable media. The customer can access their order history via their account.
Article 6: Payment
Payment is made:
— by bank card via a secure payment system,
— or by bank transfer, according to the terms indicated when placing the order.
The order is considered final after the payment has been received.
Article 7: Payment security
EUROMAST implements all necessary measures to ensure the security and confidentiality of payments made on the Site.
Article 8: Delivery
Article 8.1: Deadlines
Products are delivered via standard carrier. No express delivery is offered.
The delivery times indicated at the time of ordering are given for information purposes only. Any delay only entitles the customer to cancel the order under the conditions and according to the procedures set out in Article L216-6 of the Consumer Code (formal notice to deliver within a reasonable additional period, which remains unsuccessful) , unless the customer has demanded, at the time of ordering, delivery on a specific date or within a specific period which constitutes an essential condition for them.
EUROMAST cannot be held responsible for a failure to fulfill its delivery obligation in the event of force majeure or due to the Client or a third party unrelated to the provision of services stipulated in the contract.
Article 8.2: Transfer of Risks
The transfer of risk of loss or damage to the products is governed by Article L216-4 of the French Consumer Code: risk is transferred to the Customer when the Customer, or a third party designated by the Customer other than the carrier proposed by EUROMAST, takes physical possession of the products. In the event of loss or damage to the goods before this taking of possession, the Customer is entitled, upon simple request, to either a replacement or a refund.
Article 8.3: International Delivery
For deliveries outside France, the Customer is advised that taxes, customs duties, or import formalities may be required. These fees and formalities are the sole responsibility of the Customer, unless otherwise specified before order confirmation.
Article 9: Right of withdrawal
In accordance with Articles L.221-18 et seq. of the Consumer Code, the consumer Client has a period of 14 calendar days from the receipt of the goods (or the last goods, in the case of an order relating to several goods delivered separately) to exercise his right of withdrawal, without having to justify his decision or bear any costs other than those provided for in Articles L221-23 to L221-28 of the Consumer Code.
Article 9.1: Procedures for exercising
The right of withdrawal is exercised by any unambiguous statement expressing the Client's wish to withdraw, addressed to EUROMAST before the expiry of the period mentioned above, in particular by means of the standard form appearing in the Annex to these Terms and Conditions, also available on the Client's user account on the Site.
EUROMAST confirms receipt of the withdrawal to the Customer without delay, on a durable medium (email).
Article 9.2: Product returns and refunds
The Customer shall return or hand over the goods to EUROMAST without undue delay and, at the latest, within 14 days of communicating their decision to withdraw.
EUROMAST will reimburse the Customer for all sums paid, including the initial delivery charges (with the exception of any additional costs incurred by the Customer choosing a delivery method more expensive than the standard option offered), within a maximum of 14 days from the date on which EUROMAST is informed of the decision to withdraw. However, this reimbursement may be deferred until the goods have been received or until the Customer has provided proof of shipment, whichever occurs first.
The refund will be made using the same payment method used by the Customer for the initial transaction, unless the Customer expressly agrees to another method.
Article 9.3: Return costs
Return shipping costs are the responsibility of the Customer, both in France and abroad.
Article 9.4: Exceptions to the right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of the following goods, once they have been unsealed by the Customer after delivery and cannot be returned for hygiene or health protection reasons : personal protective equipment intended for direct and prolonged contact with the skin (technical underwear, molded earplugs, certain intimate protective equipment). The exact list of products concerned is specified on the corresponding product page before order confirmation.
Article 10: Retention of title
The products remain the property of EUROMAST until full payment of the price.
Article 11: Liability
EUROMAST cannot be held responsible for the non-performance of the contract due to the Client, a third party unrelated to the provision of services provided for in the contract, or a case of force majeure, within the limits authorized by law.
Article 12: Guarantees
Legal guarantee of conformity
EUROMAST is liable for defects in conformity in accordance with Articles L217-3 et seq. of the French Consumer Code. The Customer has two years from the date of delivery of the goods to take action and is not required to provide proof of the defect existing at the time of delivery during the twenty-four months following delivery.
Guarantee of hidden defects
EUROMAST is liable for hidden defects in accordance with Articles 1641 et seq. of the Civil Code.
Article 13: Personal Data
Personal data is processed in accordance with applicable regulations, in particular Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978, as amended. The details are set out in the Privacy Policy available on the Website.
Article 14: Intellectual Property
All content on the Site is protected by the Intellectual Property Code.
Article 15: Language
These Terms and Conditions may be offered in several languages. In case of discrepancy, the French version shall prevail.
Article 16: Consumer Mediation
In accordance with Article L.612-1 of the Consumer Code, the consumer Client may have recourse free of charge to a consumer mediator, after having first attempted to resolve his dispute directly with EUROMAST's customer service by written complaint.

Article 17: Applicable Law – Disputes
These General Terms and Conditions of Sale are governed by French law. Subject to any mandatory provisions of the consumer's country of residence that may be more favorable to them, any dispute will be submitted to the competent courts in accordance with the rules of ordinary law.
